| 摘 要： | 文章针对学理界对于一般动产抵押的怀疑态度和理由,从正确理解物权法定原则和公示公信原则的角度出发逐一论证了一般动产抵押既不会导致理论和立法的混乱,也不会导致对物权法定原则和公示公信原则的违反和公示作用的缺失。同时,文章通过对一般动产抵押制度的发展与其功效的分析论证了其存在的必要性,指出一般动产抵押的出现是社会经济发展的产物,其在理论上和实践中都是可行的。

| Abstract: | In view of suspicion attitude and reason about general chattels mortgage of scientific theory circle,the article expounds that general chattels mortgage will lead to neither theory and legislation chaos nor violation of legal principles of artical right and system of announcement.At the same time,the article expounds the existence necessity of general chattels mortgage by the analysis of general chattels mortgage development and effect,and then points out general chattel mortgage is the outcome of social economic growth and it is feasible in terms of theory and practice. |
