| 摘 要： | 本文通过"商鞅战秋菊"这一思想实验检验了法律界日益盛行的从普法到专法的法治转型主张。对法治转型的可能途径与后果的实验检验表明,由于普法型法治已经使法律面前人人知识和权力平等的观念深入人心,因此寻求建立法律职业的知识壁垒和权力格局非但不能帮助法律人建立专法型法治,而且势必走向专制和人治。法治的实现因此需要中国法律人超越职业主义和精英主义,寻求与普通民众的共识基础,探索中国的法治之路。

| Abstract: | The essay designs a thought experiment of Shangyang vs.Qiuju and examines a rising claim that the rule of law in china should be transformed from the popularized model to the monopolized one.It demonstrates that the ways and ends of the rule of law transform will not only fail to help lawyers to establish the monopolized rule of law,but tend to sink into the despotism and tyranny,due to the provided dominance of the popularized rule of law which make no difference of the knowledge and power between the experts and the laymen.Chinese lawyers should,therefore,overcome the legal professionalism and elitism and try to establish the consensus foundation among all the people for a Chinese road to the rule of law. |
