| 摘 要： | 刑法的重心在于通过刑法功能去实现刑法的目的，而刑法目的能否实现，或者能实现到什么样的程度，却与刑法的容忍度有着直接的关联。提出并着手研究刑法容忍度的问题，是因为这一概念不仅是衡量刑法价值的指标，而且还能够为拓展刑法学研究领域提供新的进路。中日两国因传统文化、社会制度等方面的差异，在刑法价值观上有着不尽相同的取向。如果从刑法容忍的角度对此展开比较分析，或许会有新的收获。

| Abstract: | The core of criminal law rests with realizing the purpose by its function,however,whether the purpose can be realized or not is direct related with endurance degree of criminal law.The article studies on the question because the concept is not only the indication of weighing the value of criminal law but also can provide with new track lever for expanding research field of criminal law theory.Due to the difference of traditional culture and social system between China and Japan,the article analyzes comparatively toleration degree of criminal law. |
