公共利益与公共悖论

本文通过对公共利益概念的历史考察 ,以及对公共利益与个人利益、集体利益的对比分析 ,将公共利益界定为 :一个特定社会群体存在和发展所必需的、该社会群体中不确定的个人都可以享有的社会价值。从公共利益的特征可以推断出现实中存在的三个“公共悖论” ,即 ,多数选择与正义原则的冲突 ;个人理性与公共利益的冲突 ;政府特殊利益与公共利益的冲突

Public Interests and Public Contrary

The public interests should be defined as the social value which is the necessity for the existence and development of a certain social group, and which can be shared by a certain individual in the social group. This definition is the result of the historical observation on the public interests, of the comparative analyses on the public interests and individual , collective interests. Three kinds of "public contrary" can be deduced from the properties of the public interests in reality, namely, majority choice and justice principle, individual reason and public interests, governmental interests proper and public interests.
