| 摘 要： | 本文在指出现行财产保全管辖制度的缺陷之基础上，分别就财产保全的管辖法院及其与诉讼管辖协议、仲裁协议的关系，以及财产保全错误时要求损害赔偿的管辖法院等问题进行了探讨，并提出了相应的立法建议。

| Abstract: | On the basis of analyzing the defects of the current attachment jurisdiction in Civil Procedure Law, the thesis discourses what is the most appropriate attachment jurisdiction, illustrates the relationship between attachment jurisdiction and agreement on jurisdiction or arbitral agreement, and discusses the adjudicatory jurisdiction when an attachment is wrong. Then the thesis puts forward some corresponding legislation suggestions. |
