| 摘 要： | 证明责任分配对于当事人权益的维护有重要意义,但也不可夸大证明责任对于媒体败诉的影响;同时,在目前的条件下,以价值分析作为新闻侵权证明责任分配的衡量标准也欠缺一定正当性和说服力.新闻侵权证明责任的倒置是部分的倒置,以过错的构成作为倒置客体,且一般只在过错推定时才实行这一倒置规则.

| Abstract: | Distribution of the burden of proof is of great significance for safeguarding the interests of parties involved.But we should not exaggerate the influence of burden of proof when the media fail in a suit.Meanwhile,in the present conditions,value analysis,as a standard of the distribution of the burden of proof,lacks legitimacy and convincing.In case of news torts,shifting the burden of proof is shifting partly,and fault is the object of the shifting the burden of proof when presumed-fault is implemented,additionally. |
