土地承包经营权入股农业公司模式及规制

在现行法律尚未许可的情况下,各地已出现多种形式的土地承包经营权入股农业公司实践,其中,农民自主的土地承包经营权直接入股农业公司的汤营模式是较优选择。土地承包经营权入股农业公司的主要障碍并不真正存在,土地承包经营权入股农业公司符合土地承包经营权的物权性质,应予以合法化。土地承包经营权入股农业公司应当坚持自愿、农地农用、入股期限不得超过土地承包的剩余期限、土地承包经营权须经依法评估等基本原则,并对公司的设立、经营及消灭等环节加以专门规制。
