试论法律移植应遵循的原则

法律移植的原则是指法律移植理论的初始原理 ,是法律移植活动的领导性规定。在我国 ,法律移植应遵循科学性原则、合宪性和法制统一性原则、变通原则和适时、适量、适度原则。这些原则对立法者慎重移植、保证移植的成功以及克服法律移植的诸多弊害 ,使法律移植顺应并促进整个社会的发展将起到积极的作用。

The Principles of the Transplantation of Law

Tenet of the transplantation of law is referring to the prelimnary principle in transplantation of law,which is leading rule of the transplantation of law. In China, principles of the transplantation of law must obey the principle of science, principle of constitution and unified legal system, principle of changing according to specific conditions, principle of timely and just the right amount and moderate degree, because those principles can make legislative person keeping calm and composed ,and pledge to fulfil the transplantation of law, and overcome many difficulties of the transplantation of law .It will produce positive role to the development of the whole society for the transplantation of law .
