高校学生工作应切实维护学生的合法权益

目前高校中大学生的合法权益被"合理"侵犯的现象时有发生。实际上,高校与学生之间存在着纵向和横向的两种法律关系,一方面高校是授权执法性主体,强调管理与服从的关系;另一方面,双方则形成了一种属于或者具有服务合同性质的民事法律关系。因此,高校在制定学校规章制度时要审慎考虑内容和程序的合法性,科学地确定双方的权利与义务,切实维护学生的合法权益。

University Students'' Legal Rights Should Be Protected in Management of Students'' Affairs

Students' legal rights are often "justifiably" infringed in institutions of higher learning. In fact, there exist two kinds of relationship between a university and its students. On the one hand, the school authorities , as the legal entity to enforce rules and regulations, require a supervision-and-obedience relationship. On the other hand, the two parties form a civil legal relationship characterized by the nature of a service contract. Thus, the university authorities should scientifically define the respective rights and obligations of the two parties and ensure the legitimacy of the regulations and the procedure in enforcement to safeguard the legal rights of the student' s.
