外国判决既判力的主观范围问题初探——以英国法为中心

既判力主观范围所要解决的问题是，一个判决作出之后，将对多大范围内的纠纷当事人产生“定纷止争”的效果。英美法系国家一般将判决区分为“对人判决”与“对物判决”，基于这两类判决的不同特征，判决既判力的主观范围也是有所不同的。而对于外国判决而言，则还涉及到内国法院对其既判力效力的承认问题。
