| 摘 要： | 识别冲突是对事实本身和法律规则本身的认识不同所导致的。识别包含有两个互相不可分割的方面 :一是事实和法律规则 ;二是识别者自身。对识别制度进行反思就会发现 ,识别者自身在以往的研究中常被忽视。这是因为识别者把要被识别的对象作为独立于我的客体对待。识别是在二者间对话的过程中完成的

| Abstract: | Characterization conflict is led from different understands on fact and rule. Characterization contains two indivisible aspects . One is the fact , the other is itself. Turning identify system over, we can discover that it had been ignored in study before. The important cause is that characterized object isregarded as exist independently. Characterizing should have finished gradually in dialoging. |
