法社会学的民间立场

传统的法学研究立足于官方立场,拘泥于“国家法”的研究范畴和自上而下的思维方式。法社会学的兴起使民间立场进入法学研究当中,它通过对法律制度、社会结构和芸芸众生生存状态的充分关注和自下而上的思维方式,以图避免法律与社会的脱节。民间立场是对传统法学官方立场的有益补充。

Folk Position of the Sociology of Law

Most of the traditional jurisprudential study are established in official position,so they are limited to the scope of "state law" and the superincumbent manner of thinking.The rise of sociology of law makes the jurisprudential study face the folk position,which considers law phenomenon from bottom to top.It pays attention on the legal institution,the social pattern and the states of the all living things so as to avoid the disjoint of law and society.The folk position that shook the traditional scientific standpoint is a good complement to the official position of the jurisprudential study.
