| 摘 要： | 刑事证明标准在诉讼中究竟能否解决实务中裁判的精确性问题,历来存在争议。标准实则具有两层含义,一为技术性指标;另一为抽象性目标。前者具有明确的可测量性,后者只具有引导和指向功能。司法裁判中的证明标准不可能具有刚性的测量功能,而只具有目标型性的导向功能。立法与司法应将目光从对裁判精确性的不确定追求转向对可控的公正程序与证据规则的合理关注和构建,从而确保判决的可接受性。

| Abstract: | There always exist controversies between the scholars that weather the proof standard in criminal procedure can prove the truth in trial.Standard actually includes two ideas:one means technical norm and the other means spiritual aim.The former has its function of examination and the latter has guidelines on spiritual meaning.The proof standard in judicial field only means its spiritual idea.Legislative body and effective body would put the attentions on due procedure and the rule of evidence rather than the accuracy of the case which can't be certain for sure. |
