| 摘 要： | 竞技体育行为是作为一种正当业务行为而具有刑事正当性的。技巧性比赛、身体接触较轻微的的对抗性比赛、训练中的体育活动以及非职业性体育活动都有可能作为刑法中的业务行为对待。竞技体育行为的正当化根据在于存在着优越于身体伤害这种可能风险的利益,正当化要件则包括主体、时空和规则诸方面。

| Abstract: | Competitive sports behavior has criminal justification for being one kind of justified business behavior.Skillful competitions,body contact of minor antagonism,sports activities in training and non-occupational activities have the possibility to be regarded as business behavior in criminal law.Competitive sports behavior is justified because some interests exist which are superior to the potential risks of harming the body.The elements of justification include the aspects of identity,space-time and rules. |
