宅基地使用权流转的内生机制与法律调适：浙江个案

所谓宅基地的限制交易只是相对于城市居民到农村买房而言,乡村社会内部其实一直存在原有受村庄自身内部规范调解的宅基地交易机制。原有的内生流转机制保证了村社共同体内部民众的集体主义和公平感,但这一规范由于宅基地向村外人的流转而遭到破坏,村社共同体为维护村民的相对公平感和平均主义心态舍弃了原有的村内宅基地审批的非正式规则,而采取了严格按照国家和政府有关政策文件的审核标准,因此也导致了规则前后矛盾不一所产生的纠纷。现阶段宅基地流转中必须要考虑到流转的乡村社会基础问题,宅基地流转首要的问题是要保证村民起点的公平。
