| 摘 要： | 现代司法理念尤其是英美法系国家的司法理念总是强调裁判权在刑事司法正义中的独立性，强调法官在刑事司法正义输出中的绝对地位和作用，弱化或者忽视检察官的地位与作用。但从检察制度的历史发展、检察官在刑事司法体制中的角色以及中国现实的检察制度等方面考察，刑事诉讼中检察机关的检察权和法院的裁判权具有同等的重要性，刑事司法正义是法官和检察官司法共治的结果。
