审判独立无疑是司法改革进程中牵一发而动全身的焦点所在.为了保障司法公正实现社会正义,审判必须独立,但不受监督的权力必然走向腐败,对审判权实施监督不仅有充分的理论基础,而且我国目前的法官队伍现状、司法腐败现象、司法权威和司法公信力现状构成了对审判权实施监督的实证依据.因此,在逐渐提升审判权地位的同时必须重视对其的监督.

On the Necessity of the Supervision to Jurisdiction——A Realistic Analysis

The trial independence is the focus of the public in the course of judicial reform. To realize the judicial justice and the social justice, the trial independence is necessary, but power must be to corrupt lacking of supervision. Besides the enough theoretic basis,there have many realistic bases to the supervision to the jurisdiction,including the structure of the judiciaries, the phenomenon of judicial corruption, the lacking of judicial authority and judicial belief in the public. So when advancing the status of jurisdiction, we must emphasize the supervision to jurisdiction , too.
