洛克早期自然法思想初探

洛克早期自然法思想是现当代西方学界关注的一个重点。与一些学者主要以《政府论》下篇中个人与人类的保存来理解洛克的自然法思想不同，文章立足洛克早期著作《自然法论文集》，从自然法的本质、对自然法的认识，以及自然法与政治社会的实证法的关系等三个方面，对洛克早期自然法思想加以澄清。从中可以看出洛克的自然法思想的深刻校和复杂性。

On Locke'Early Theory of Natural Law

Locke's theory of natural law is a focal point of attention among modern western scholars. In contrast to some who understand Locke's theory mainly in virtue of the preservation of individuals and mankind, this paper turns to the early work of Locke, Essay on the Natural Law, and makes a clarification from three aspects, namely the essence of natural law, the acquisition of the knowledge of natural law, and the relation between natural law and positive law. Thus we can get a clear understanding of the profundity and complexity of Locke'theory.
