| 摘 要： | 犯罪所得没收制度是实现腐败财产追回的强制措施之一，也是实现国际间腐败财产追回合作的重要途径。《联合国反腐败公约》以及英、关、法等国家相关法律对此已有较为完善的规定，而国内相关立法尚有不足。以《联合国反腐败公约》为依据，在借鉴英、美等国法律规定的基础上．为有效打击和控制腐败犯罪的跨国发展，实现国际间司法合作之需要，建立和完善中国腐败犯罪财产没收制度立法：对现有刑事附带民事诉讼程序进行改造；建立类似于英美法系国家独立的民事没收制度。
