建议设立“医务人员受贿罪”

面对不断突出的医务人员收受回扣的行为,当前立法却出现了空白缺失,理论上对于是否需要以及如何进行刑法规制存在争议,实践中做法也甚为混乱。要研究和解决这一问题,必须科学合理地分析医务人员收受回扣行为的特殊性及其与国家工作人员受贿行为,公司、企业或者其他单位人员受贿行为的区别,正视这种差异,通过设立独立的新的罪名来实现对医务人员收受回扣行为的有效打击。

Suggest Enacting Crime of Accepting Bribes of Medical Personnel

Acceptance of bribe is very currently behavior of medical personnel.Legislation has no proper rules.Whether we need criminal law or not,and how to rule this kind of behavior are on the dispute.There also has confusion in practice.To study and solve this problem,we should analyse the peculiarity of acceptance of bribe of medical personnel and find the differences between this behavior and two other similar act of accepting bribes,which are government staff and company enterprise and other personnel.Enacting a new crime to hit this behavior effectively should be advised.
