转基因水稻产业化中的专利问题分析

我国转基因水稻已获国家安全证书,向商业化生产迈出了重要一步。在转基因水稻的产业化中,相关的知识产权问题乃是众多法律问题中的基础性问题,与转基因水稻相关的专利检索则是我国制定相应的知识产权战略的基础性数据。采用专利检索的方法,在对相应检索范围进行框定,检索数据进行筛选、整理与分析的基础上,得出相应的结论,并从如何应对国外专利策略、提高国内专利申请水平、加强各方主体的职能与合作、保护农民权益等角度提出了建议。
