论自然人民事责任能力

自然人民事责任能力是民法的基本理论,关系着行为人本人的责任、监护人的替代责任、受害人的赔偿请求权的实现,以及诉讼中当事人的确定等。虽然人人均有民事权利能力,一切自然人均具有民事责任能力,但民事责任能力又不包含在民事权利能力之中,它是公权关系下的公权意志的体现,是与私权关系下的民事权利能力相平行的一个概念。

Study On Civil Liability of Natural Person

Civil liability of nature person is the basic theory in civil law.Its associate with responsibility of nature person,with vicarious liability of guardian,with right to compensation of the injured party and with definite parties in lawsuit.This article reviewed the main theory of civil liability,concluded that all nature person should have the civil liability.This article discussed that the civil liability is not same with the civil night,it is parallel to the civil right.
