弱者的制度性生产与再生产

相对于自然原因,弱者产生的社会原因更受关注,弱者在权利享有、实现、救济上的弱势地位是造成他们弱势并导致这种弱势境况恶化的根本原因。经由法律所生产出来的弱者,同时又成为法律的调整对象,类似于社会再生产的过程,而弱者的再生产过程同时往往也是"弱肉强食"逻辑的再生产和结果取向的功利哲学的再生产。旨在保护弱者的法律制度若设计不当,不仅会出现非保护对象的对策行为或者"溢出效应",还可能会导致弱者更弱的制度陷阱。相对于给予弱者以特殊的照顾,作为公平正义之保证的社会体制更应优先被关注,实际的不自由和对权利的普遍侵害才是弱者产生的根本原因。
