| 摘 要： | 从本质上讲,司法立法与立法机关立法、授权立法一样,均属于立法权行使的一种方式,但由于其立法主体和立法方式均具有一定的特殊性,故司法立法在诸多方面有别于立法机关立法和授权立法,这表现在它的产生原因、发展及现实的具体运作等方面。
