清洁生产法的利益机制探析

探讨清洁生产法制赖以存在和发挥作用的利益机制是制定和实施它的重要基础和理论前提,计划经济体制下不可能存在清洁生产和清洁生产法;市场经济条件下,企业清洁生产以及相应的法律调控才成为可能。市场机制既有转嫁企业环境成本的固有倾向,同时又与清洁生产存在着某种程度的兼容、和谐的一面,使得政府依法通过经济刺激、信息公开、行政合同和行政控制等综合性手段调控企业清洁生产活动具有可能性和必要性;三元模式下的市民社会具有重要作用,公众知情权与参与权应当得到清洁生产法的确认。
