美国反托拉斯法的司法特点及其启示

文章从 2 0世纪美国反托拉斯法与剧增的垄断行为并存的经济现象出发 ,通过对反托拉斯法条款本身、反托拉斯司法特点的分析 ,旨在弄清美国反托拉斯法实际在反托拉斯行为及推动垄断进程中的作用。在分析中 ,针对我国实际状况 ,在对垄断问题的重新认识、建立大型垄断性企业集团、强化政府作用及加快反垄断立法等问题上得到了一些启示。

Judicial characteristics of Anti-Trust in America and the Inspiration to China''s Economy

This article is focused on analyzing the judicial characteristics and the items of anti trust law to make clear the functions it plays in the process of promoting monopolization and opposing the anti trust activities.All the analyses are based on the phenomenon of anti trust law and those monopoly activities existing in the twentieth century.In the analyzing,some important inspirations are also proposed on the issues such as understanding monopoly problems,establishing large scale monopoly groups,reinforing the functions of government and improving the pace of legislation.
