论在著作权原始归属中引入契约制度

我国现行的著作权法中作品类别有自然人作品、法人作品、职务作品、合作作品、委托作品等类别,这些作品分类的标准并不十分的确定,文字规定较为模糊,而这些不同种类的作品的划分又直接关系到作品权利的归属,作品种类的划分界限不明确导致权利归属认定上争议。只有解决作品类别的划分问题,才能让权利归属的认定没有争议。
