中国食品安全的刑法规制

摘    要:近年来,中国食品安全案件接连发生,中国刑法学界对食品安全犯罪给予了较多的关注。从中国食品安全的刑事立法沿革来看,可以分为三个时期:1949年至1979年的非犯罪化时期、1980年至1996年的犯罪化时期、1997年至今的完善和扩张期。晚近中国食品安全刑事立法呈现出刑法介入的时间提前、刑法介入的范围扩展、刑法介入的力度趋严等特点。未来中国食品安全刑事立法的完善应注意法益保护与人权保障的平衡、促进刑罚结构从"厉而不严"走向"严而不厉"、加强对立法技术的反思、实行真正的附属刑法与刑法典相结合的立法模式。

Abstract:Recently,many legal cases concerning food security have occurred in China and as a result much attention has been paid to food safety crimes in the field of Chinese criminal law.The criminal legislation of food security in China has evolved in three stages: no-criminal legislation from 1949 to 1979;making criminal legislation from 1980 to 1996;improving and expanding criminal legislation from 1997 till now.The latest and recent legislation reveals such features as early involvement,expansion of the scope,and the in-depth legal involvement.In the future the legislation of food security in China shall be improved by balancing the protections between legal interest and human rights,promoting the penalty structure transition from "severe but not strict" to "strict but not severe",further reflecting legislative technology,and actually implementing the legislative pattern which integrates the subsidiary criminal law and the criminal code.
