对“感情破裂”的离婚条件的反思

离婚标准是国内外婚姻法的重要内容,我国1950、1980和2001年婚姻法都将“夫妻感情确已破裂”作为诉讼离婚标准。但感情破裂原则并非是科学的、客观的离婚标准,该规定忽视了婚姻的伦理性,也超越了我国现阶段的社会状况。因此,应用更科学合理的“婚姻关系不能维持”作为离婚标准,以保障公民婚姻自由,因为相比较而言,它具有更好的包容性和司法上的可操作性,也更符合现阶段真实的婚姻家庭状况。

Reflections on "Mutual Affection No Longer Exists", the Condition for Divorce

Conditions for divorce are one important part of any marriage law.Marriage Law of the People's Republic of China in 1950,1980,and 2001 all provide that one condition for divorce proceedings must be "mutual affection no longer exists".This paper argues that this condition is not scientific and objective,for it ignores the morality of marriage and oversteps China's current social conditions.Therefore,it should be replaced by a more scientific and reasonable condition that "the marriage can not be maintained" so as to guarantee citizen's freedom of marriage because this new condition is more tolerant and practical in judicial practice,and better conforms to the current reality of marriage and family.
