自然资源特许经营许可申请人受益权初论

以行政许可申请人的权利保护为视角,讨论了行政许可申请人受益权的含义,并在此基础上阐述了自然资源特许经营许可申请人受益权的主要特征及我国自然资源特许经营许可申请人受益权保护缺失情况,进而提出首先应当在自然资源特许经营许可制度中设定行政许可申请人受益权,并加以严格的界定和合理的制度设计,以平衡政府权力和个人权益之间的冲突。

On the Benefit Right of Applicants: Their Special Permit Management on Natural Resources

From the perspective of protecting the right of the applicants for administrative permit, this paper discusses the connotation of the benefit right of those applicants. Then it analyzes the main characteristics of the benefit right of the applicants who have special permit management on natural resources. Because those Chinese applicants are lack of protection for their right, the paper maintains that in the system of special permit on natural resources it is necessary to establish benefit right first for the applicants having administrative permit and then to define it strictly and reasonably so as to settle the disputes between the governmental power and the individual benefit.
