《民族民间传统文化保护法(草案)》的特点及立法建议

已经进入第6稿的《民族民间传统文化保护法(草案)》吸收了国内外相关法律法规的宝贵经验,具有以下几个特点:以保护非物质文化遗产为主,兼顾保护相关物质文化遗产;确立了文化部门的行政主管部门地位;以分级保护管理为原则;实行以行政保护为主、以民事保护为辅的保护措施。但是,《民族民间传统文化保护法(草案)》在命名上有不妥之处,相关知识产权的法律规定也不够具体、明确且欠缺可操作性。

Main Features of Law on Safeguarding Chinese Ethnic Traditional Culture and Folklore and Some Suggestions

The draft of the Law on Safeguarding Chinese Ethnic Traditional Culture and Folklore reaches its sixth edition now. The draft has absorbed some provisions from relevant laws at home and abroad and showed four main features as follows: for the main purpose of protecting the intangible cultural heritage and simultaneously taking some consideration on the tangible cultural heritage; authorizing the Cultural Administrative Office as the administrative organ; classifying the intangible cultural heritage as a basic principle for protection; taking both administrative measures and civil measures. But there are some imperfections which need to be revised in the draft, such as the nomination and the provisions in intellectual property field.
