完善我国自贸区临时仲裁制度的法律思考

临时仲裁作为世界主流的仲裁模式之一,在国际商事仲裁中发挥着重要作用。在自贸区内引入临时仲裁制度具有重要的积极价值,但从目前发展现状与存在问题来看,临时仲裁制度引入自贸区面临诸多挑战。基于此,自贸区应从不断加强临时仲裁在法律体系的承认与支持、推行示范性临时仲裁协议条款、完善临时仲裁员的选任与监督机制、明确司法干预临时仲裁的限度等角度完善临时仲裁制度。

Legal Thoughts on Perfecting the Ad Hoc Arbitration System of China's Free Trade Zones

As one of the mainstream arbitration modes in the world, the ad hoc arbitration plays an important role in international commercial arbitration. It is necessary to introduce the ad hoc arbitration into the free trade zones for the internationalization development of China''s commercial arbitration system.By analyzing the present situation and existing problems of the development of ad hoc arbitration in the pilot free trade zones , it is concluded that the system still faces many challenges . The free trade zones should take some ways to perfect the ad hoc arbitration system, strengthen the recognition and support of the ad hoc arbitration in the legal system continuously, promote the terms of the model ad hoc arbitration agreement, perfect the selection and supervision mechanism of temporary arbitratorsand define the limits of judicial intervention in the ad hoc arbitration.
