网络游戏直播中的著作权问题探究

互联网经济催生了游戏产业和直播产业,随着网络游戏直播产业的兴起,其中涉及的著作权问题也日益凸显。网络游戏和网络游戏画面的客体属性及权利归属是研究该问题的基础和突破点,其中玩家在网络游戏画面中的法律地位认定是争议的核心。玩家操作游戏不是创作行为而是传播行为,宜在我国《著作权法》修改之际整合包括网络游戏直播行为在内的所有传播行为,归入"向公众传播权"的调整范畴。在判断网络游戏直播行为能否构成合理使用时要着重考量"转换性使用"要素和对原作品潜在市场和价值的影响,这也符合《伯尔尼公约》中"三步检验法"的要求。
