| 摘 要： | 全球化是当代世界的潮流,是理论创新的时代背景。中国法学在全球化中表现出来的是集体性的"西方"转向。但这种理论转向存在着视野上的盲点,需要对"西方"进行重新定义。中国现代法制和法学的创建源于前苏联,是以其法学理论和法律思想作为研究对象,因此,需要对其进行知识论和方法论的重构。
