论外空软法的发展和功用

外层空间软法是指国际社会在探索和利用外层空间的过程中形成的，不具有法律约束力，但能够产生实际执行效力的区别于条约和习惯的国际法律规范，通常表现为国际组织和国际会议的决议、宣言。伴随着空间活动的逐步深化，外层空间软法的发展也经历了四个主要阶段，具有鲜明的时代特点。外层空间软法为条约的制定和习惯的形成起到了推动的作用，在缺少条约和习惯时也起补充规范的作用，不断推动着外层空间法律体系走向完善。

It cannot be categorized as treaty or custom, and it is usually resolution or declaration of international organizations and conferences. With the development of various space activities, the evolution of soft law in outer space can be divided into four main phrases with their own historical characteristics. Completing the legal regime of outer space law, the outer space soft law has boosted the development of treaty and custom in outer space law, and it is also the complementary regulation when no treaty or custom can be applied.
