| 摘 要： | 刑讯逼供是现代社会司法中存留的酷刑之典型表现,它是对人类固有尊严的践踏,是对法治的公然挑战。刑讯逼供之所以在现代司法中根深蒂固,除相关制度不完善的原因外,负载显示权力运作之社会功能是其现实的背景性原因,无“个体”与“自我”认同的传统法文化精神的浸润乃其内在的根源。

| Abstract: | Extorting a confession by torture is model behavior of cruel torture in modern society, it is the trample of mankind's inherent dignity, the open challenge governing of law. It is deep-rooted to extort a confession by torture in the modern justice, besides reason of not perfect of relevant systems, the social function that load shows power operation is its realistic background reason, contamination of traditional law cultural spirit that doesn't admit “individual”and “oneself”is his inherent origin. |
