| 摘 要： | 从实践和法律角度对绿色壁垒定位,认为绿色壁垒即是新贸易保护主义,也是当前国际社会的一种特定行为规则。在国际秩序既定游戏规则下,要跨越绿色壁垒滥用对本国造成的不利,首先要读懂规则,依规则行事;其次要抓住规则体系中导致权利被滥用的法律空隙,利用规则应对冲突和维护国家权益;还要在增强自身实力的基础上完善国内立法,积极参与国际谈判,抵制假“绿色”之名的新贸易保护主义,寻求国际秩序与国家主权的平衡。

| Abstract: | Based on analysis of practice and law,the green barrier is defined as a new trade protectionism and a special formula in the world. Under the established game rule,in order to eliminate the disadvantages caused by the abuse of green barriers,we should firstly understand the regulations and conduct according to the rule.Secondly,we should make use of the law gap that always causes the power abuse,thus to cope with the conflicts.Besides,economic,legal as well as diplomat ways should also be used to reject the trade protection in the name of "green" so as to seek for the balance of international order and nation sovereignty. |
