产品责任立法国际统一化研究--兼论我国产品责任立法之完善

产品责任立法的国际统一化必须建立在各国的产品责任法朝着国际化发展的基础上.它并不是取代各国的产品责任立法,而是通过各国政府和国际社会的共同协作,制定一套跨国的产品责任规则,以解决各国产品责任侵权纠纷。我国产品责任立法起步较晚,但已经形成规模,并具有自己的特点。在全球经济统一化的进程中,我国产品责任立法的完善,必须吸取外国先进产品责任法律制度中对我们有益的成分,去粗取精,结合我国的国情,制定相应的专门法规。

On Internationalized Unity of Products Liability Legislation --And on Legislation Improvement of Products Liability in Our Country

Internationalized unity of products lability legislation must be based on the internationalization to which individual country's legislation of products liability develops.The intention is not to replace the legislation of products liability in individual nations,but intend to make a series of international products liability regulations through joint collaboration of governments in the world,in order to solve the torts concerning products liability in each country.The legislation of products liability in our country,although initiated recently,has shaped into a (certain) dimension with its own characteristics.With the economic globlization,the improvement of the legislation of products liability in our country must include the profitable parts of advanced products liability legislation in other countries,excluding the shortcomings and form of special laws which fit the situation in our country.
