摘    要:罢工权是集体合同制度有效施行的有力保障。而我国目前的立法当中没有明确规定罢工权,对罢工现象缺乏有效规范。为了使集体合同制度落到实效,更好地保护劳动者的权益,立法应明确规定工人享有罢工权,并对其加以适当限制以保证其得以正确行使。

Abstract:Exercising strike rights is a forceful guarantee of effective operation of group contract regulations.However,there lacks clear definition of strike rights in current laws in China,which leads to inadequate regulation of strikes.In order to effectively carry out group contract regulations,and to better protect employees' interests,there should be clear definitions that employees enjoy strike rights and make proper restrictions so that strike rights can be correctly practiced.
