立法法编纂研究

《中华人民共和国立法法》是我国法律体系中一部规范立法活动的重要的宪法性法律,其编纂和颁布为立法法治奠定了基础,为将国家立法活动纳入法的轨道提供了先决条件。立法法编纂的背景及其历史动因在于提升立法法规范地位、提高立法质量、推进依法治国进程,并适应全球化趋势。立法法编纂的成功与缺失同样明显,《立法法》颁布本身即为立法法编纂的最大成功;立法法制度与司法的协调性欠缺、立法法与宪法和相关组织法等法律渊源的协调性欠缺为其主要缺失。立法法编纂技术以及成文法自身的滞后性局限是《立法法》存在质量问题而受到批评的原因。

A Research on the Compilation of Legislation Law

The Legislation Law of the(People's) Republic of China,which regulates legislation(activities),is an important constitutional law in(China's) legal system.The background and historical cause of its compilation are to promote the status of legislation law,to improve the quality of legislation,to push forward the course of rule of law and to follow the trends towards globalization.There lie both successful and weak points in the compilation of Legislation Law.The promulgation of the law itself is the greatest success,and the main weak points include the conflicts between legislation law system and the judicial system,the lack of its harmony with the Constitution and relevant organic laws.The compilation(techniques) of legislation law and the limitations of statute law such as hysteresis effect are the(fundamental)reasons why Legislation Law is criticized.
