| 摘 要： | 劳动契约是从民事契约中发展而来的,二者有着共同的经济基础和道德基础,只是在限制契约自由的力度上,劳动契约表现得更为突出。对该限制的具体体现进行了阐述;在限制契约自由的同时,也应保有自由的灵魂。对弱者的再生式保障与对契约当事人的一体保护,必将促进契约自由在劳动契约中得以实现。

| Abstract: | Labour contract is developed from civil contract,which has common foundation of economy and morality.But labour contract shows protuberantly the strength of limiting contract freedom.This article elaborates concrete limited display,at the same time keeps the soul of contract freedom,in order to protect the weakl and all the persons concerned. |
