| 摘 要： | 道德与法律是调整人们行为和维持社会秩序的两种重要的社会规范,二者的关系是法哲学的基本问题。传统康德理论模式,提出了内在的道德与外在的法律。分析实证主义法学主张道德与法律是可分的,彼此没有必然联系。自然法学理论强调法律之道德性。这些观点,尽管都有偏颇,但毕竟为我们处理道德与法律关系问题提供了理论场景。

The analytical positivist jurisprudence and the natural law science disputes about morals, but it has important practice meanings to realize the ruling by law at the present in our country. |
