| 摘 要： | 反垄断法的实现程度有赖于反垄断执法机构的设置。在学术界的讨论中有着各种各样的理论,但借鉴国外立法不等于照搬国外立法。盲目设立专门的独立的高度权威的执法机构虽是国外成功经验,在我国却会引起各方面的问题。因此我国反垄断执法机构的设置应当考虑中国自身的传统与现实,在商务部下设立反垄断司执行反垄断职能。

| Abstract: | The execution of anti-monopoly law depends on the executing agency. In the theory field, there are all kinds of viewpoints.But consulting foreign countries' methods may not work in China and on the contrary may lead to a wrong way. So we should consider about our own characteristics and impower Chinese Ministry of Commerce to do the work. |
