论德治的现代转型

在实现治国方略由人治向法治的转变过程中 ,江泽民提出了法治与德治相结合的思想 ,这是对我国优秀文化传统的批判继承 ,是我国长期革命经验的科学总结。这里的“德治” ,不是与人治、法治直接对应的范畴 ,而是在法治方略中强调道德与法治的关系问题。德治是一种以道德规范约束行为的非正式的制度约束 ,然而 ,它在法治中却处于一种基础的地位。在社会主义市场经济条件下 ,德治实现了其经济基础、地位和作用等现代转型。我们在法治过程中 ,必须加强道德建设 ,以德治国 ,这样才能维护国家的长治久安 ,开创国富民强的新局面。

On the Modern Transformation about Rule of Virtue

During the course of transforming from rule by man to rule by law in realizing his plan to administer state, Jiangzheming puts forward the thought of combining rule by law with rule of virtue.It is dialectical inherit of our splendid moral traditions and scientific conclusion of our country's revolutionary experience.The conception of"rule of virtue" in this essay is not a catagory which opposes against rule by man and rule by law, it just emphasizes the relationship between moral and legal.Though it is an informal systematic restraint which is confined by moral standard,it lies in afoundmental place and role.Under the Socialism marked-oriented economy, rule of virtue has been transformed on economic base, status and function etc. we must strengthen rule of virtue in the course of rule by law. Only do this, can we maintain nation's long stability and initiate a new situation of our country's prosperity and people's richness.
