| 摘 要： | 伊斯兰法的创制是一既传统又现代的问题.随着当代伊斯兰复兴运动的兴起,这一问题再度被提起,有关伊斯兰法的创制大门的关闭与敞开,及其在现代社会条件下的作用等相关问题,引起了广泛讨论.本文从伊斯兰法创制的概念与特征、依据与范围、价值选择及创制大门的关闭与否四方面阐析了这一问题.

| Abstract: | The author holds that the inauguration of the Islamic law,a study both ancient and modern,has got its revival with the Islamic Renaissance Movement and issues concerning the closing and opening of the Grand Gate of the Islamic law has aroused debates of a controversial nature.The paper approaches the issue from four aspects: the concepts and characters,the guidelines and scope,the choice of values,and the opening and closing of the Grand Gate of the Islamic law making. |
