| 摘 要： | 价值哲学在国外发展有100多年的历史，上一世纪80年代起我国哲学界开始对价值哲学进行广泛研究。中外学者对价值和价值取向概念的理解，没有统一的看法。价值是主体与客体之间的一种关系。价值取向是一定主体基于价值观念面对价值冲突进行价值选择时所采取的行动方向。我国法学界对法的价值的理解，并没有超出哲学上对价值的理解。在法的价值取向中，比较有意义的是立法价值取向和司法价值取向。
