| 摘 要： | 在法治社会已逐渐完善的当代,研究法律与语言的关系问题已经成为法学研究的一个重要课题。法律和语言二者不可或缺,法律的特质有赖于语言的本体而存在,但是,语言本身的弊病又不可避免地模糊了法律用语的准确性,这就需要法律自身加以调节,可以说法律是语言的内在,语言是法律的外在表现。从边缘性学科的视角来看,法律和语言密不可分,语言是法律的载体和工具,法律又在一定程度上形塑着语言。从边缘性学科的视角研究法律与语言的关系可以助益法律的适用。

| Abstract: | The relationship between the law and language has become an important subject in the studies of law currently when the rule of law in society has been gradually improved.The law and the language rely on each other,legal quality being defined and clarified by language.However,with its defects,language inevitably blurs the accuracy of the legal terms.From the perspective of frontier sciences,law and language are inseparable as language is the vehicle for law and is shaped by law to a certain extent.Such studies of law and language will contribute to the more appropriate application of law. |
