完善农地承包经营权制度的法律思考

中共中央《关于推进农村改革发展若干重大问题的决定》对完善农村土地承包经营权提出了进一步要求,就法律层面而言,《物权法》专章规定了用益物权编,明确了农地承包经营权物权属性。但农地承包经营权登记制度并不完善;物权化救济方式难以实现;农地流转受制约因素诸多;同时在征收过程中公共利益界定不明,征地补偿不足;农民合法权益得不到充分保障等问题。今后农地承包经营权制度设计必须对以上相应制度进行完善。

Legal Research on the Improvement of the Operation of Land Contracted System

Decision of the Central Committee of the CCP Concerning Major Issues on Promoting Rural Reform and Development has brought forward clear and definite requests to perfect the operation of land contracted.Real Right Law defines the usufructuary and the real right attribute of the operation of land contracted in a chapter.But the registration system of the operation of land contracted is imperfect;property remedies are difficult to realize;the farmland circulation is restricted by many factors;the public interest is unclear in the collection process,and land appropriation compensation is not enough;farmers’legal rights cannot be protected.Therefore,the operation of land contracted must be improved.
