| 摘 要： | 本文对"请不请律师都一样"及"刑辩难"现象进行了评析,在指出传统诉讼文化及观念的影响是根本(深层)原因,控强辩弱的控辩式诉讼模式是直接原因的基础上,提出了转变诉讼观念,修正法律并真正实现控辩平衡的建议.

| Abstract: | The article illuminates the reasons why people don't want to ask a lawyer a favor and why a lawyer doesn't like to do criminal cases. The reasons are the results of traditional criminal ideas and criminal procedure, where the accusing party is stronger than the defending party.Finally,the author presents some suggestions. |
