| 摘 要： | 最密切联系原则适应了国际社会迅速发展的形势需要，满足了国际社会对法律适用的公正性与合理性的追求。然而，最密切联系原则有利有弊，既不能将其奉若神明，也不应该完全否定其价值，而应从辩证的角度对其进行客观综合的分析评价，使其更好地为各国立法和司法实践服务，成为冲突法中的中流砥柱。

| Abstract: | The doctrine of the most significant relationship, corresponding to rapid development of international community, satisfies the pursuit of fairness and rationality. However, it has two sides. We could neither overstate its role nor deny its value, but should analyze and appraise objectively from dialectic angle in order to make it serve well legislation and judicial practice and become mainstay in conflict law. |
